Request for Submissions - Intimate Images Damages - Respondent

The next stage in the CRT process is having a tribunal member review the evidence and information. They will make a decision about the damages claim.

This form will help you give all the information a tribunal member needs to make a decision about the damages claim. These questions are not legal advice. You should also fill out the "Request for Submissions - Intimate Images Protection Order - Respondent" form.

You can fill out this form by yourself, with a helper or representative, or with your CRT case manager. If you don’t want to fill out this form, ask your CRT case manager for other ways you can give us this information.

Damages

Damages are money the applicant wants you to pay them for the harm the sharing or threats caused them, or to punish you.

There are three types of damages the CRT can order under the Intimate Images Protection Act:

  • Compensatory damages make up for a loss someone suffered
  • Aggravated damages make up for mental distress
  • Punitive damages are a penalty against you for sharing (or threatening to share) the intimate image

If you want to make your own claim for damages against the applicant, this is called a counterclaim. Damages claims at the CRT are limited to $5,000 or less. Ask your CRT case manager for more information and instructions.

Explain why you think the CRT shouldn't order you to pay damages. For example, did you believe you had the applicant's consent to distribute the intimate image in the way you did, or that distribution was in the public interest? You must give evidence to support your position, like a text or email showing the applicant agreed that you could share the image.
