On May 1, 2023 we updated the CRT Rules.
What did we update?
The changes are intended to make the CRT Rules clearer and more consistent. Some words have been changed to make them more readable but do not change the meaning.
Other changes update or give more guidance on how to do certain things. For example:
- We’ve added the ability for the tribunal to withdraw permission for a representative [Rule 1.16(10)]
- We’ve updated the rules for serving a dispute notice to a strata corporation [Rule 2.2(6)]
- We’ve added information about serving a Dispute Notice to a deceased individual [Rules 2.3 and 2.4]
- We’ve added a requirement for applicants to attempt all methods of serving the Dispute Notice before requesting service directions [Rule 2.9(3)]
- We’ve revised the timing for providing expert evidence [Rule 8.3(1)] and for requesting an oral hearing [Rule 9.1(5)]
What were the results of the public consultation?
The CRT recently invited feedback on the proposed amendments from members of the public, stakeholders, and people who work for the CRT. We received some helpful feedback and made further changes in response. The rules are better as a result. Thank you to everyone who took the time to comment on the draft rules.
What are the CRT Rules?
Courts and tribunals usually have rules. The CRT Rules are a bit like an instruction guide and set out a fair, transparent, and consistent process for resolving claims.
The CRT’s mandate requires that it be accessible, speedy, economical, informal, and flexible. Because of that, we want the rules to be as clear and easy to use as possible. We have used feedback from CRT participants and stakeholders to review and update the Rules several times since we started accepting claims in July 2016.
How do people use the CRT Rules?
If we’re being totally honest – we hope people using the CRT don’t actually have to look at the CRT Rules very often! We try to build processes and guides that speak for themselves, and give you the information you need, when you need it. But when people need or want to read our complete rules, they are available here.
